Types of Land Records in Himachal Pradesh

Understanding the key land record documents is crucial for any property owner or buyer in Himachal Pradesh:

  • Jamabandi (Record of Rights - RoR):
    • The most important land record document.
    • Provides comprehensive details of land ownership, cultivation, land type, area, land revenue payable, and encumbrances (e.g., mortgages).
    • A new Jamabandi is typically prepared every five years.
    • Serves as legal proof of land ownership.
  • Shajra Nasb (Genealogy Tree / Pedigree Table):
    • A document showing the family tree and succession to ownership rights within a revenue estate.
    • Helps in understanding the historical lineage of property owners.
  • Mutation Register:
    • Records all changes in land ownership or rights due to sale, inheritance, gift, mortgage, or other transfers.
    • Entries from the Mutation Register are eventually incorporated into the Jamabandi when it is updated.
  • Khasra Girdawari:
    • A register of harvest inspections conducted by the Patwari (village accountant) twice a year (usually October and March).
    • Records details of crops grown, soil conservation efforts, cultivation status, and capacity of the cultivator.
  • Khewat Number: Represents the group of co-sharers or owners in a particular land parcel.
  • Khatauni Number: Provides details about the cultivators and their respective shares in a land parcel.
  • Khasra Number: A unique plot identification number assigned to a specific parcel of land within a village.

These documents are vital for establishing clear land titles and for any property-related transactions.

Property Registration Process in Himachal Pradesh

Property registration in Himachal Pradesh is governed by The Indian Registration (Himachal Pradesh Amendment) Act, 1968, ensuring legal validity and clear title transfer. The process involves several steps, generally carried out at the Sub-Registrar's office:

  1. Document Preparation: Draft the Sale Deed (or other relevant deed like Gift Deed, Lease Deed) on appropriate non-judicial stamp paper. Ensure all details are accurate and complete.
  2. Stamp Duty & Registration Charges Calculation: Calculate the applicable stamp duty and registration fees based on the property's value (as per circle rates or actual market value, whichever is higher), location, and gender of the buyer. This can often be done online via the Revenue Department's portal or NGDRS portal.
  3. Payment of Duties: Pay the calculated stamp duty and registration charges. This can be done online through authorized gateways like SHCIL or offline at designated banks/treasuries.
  4. Appointment with Sub-Registrar: The buyer, seller, and two witnesses must visit the jurisdictional Sub-Registrar's office on the appointed date and time.
  5. Document Verification: The Sub-Registrar (SRO) verifies all submitted documents, ensures the transaction is legitimate, and confirms proper stamp duty payment.
  6. Identity and Biometric Verification: The SRO records the photographs and thumb impressions/biometrics of the buyer, seller, and witnesses.
  7. Deed Registration: Once satisfied, the SRO registers the deed, officially recording the transfer of property.
  8. Collection of Registered Deed: The applicant can collect the registered deed from the Sub-Registrar's office, and the property details are updated in the online land records (Himbhoomi).

Timely and accurate registration ensures legal ownership and avoids future disputes.
